The Official Liquidator, High Court, Madras v. Nil

Comp.A.No.387 of 2022 C.P.No.63 of 2013 SENTHILKUMAR RAMAMOORTHY, J By this application, the Official Liquidator seeks permission to engage the services of Sri.J.Naresh Kumar, Advocate, to prosecute the appeal before this Court against the order of the Income Tax Appellate Tribunal.

2. In the report filed in support of this application, it is stated that a sum of Rs.1,06,99,865.50 is available to the credit of the company in liquidation. The Official Liquidator has annexed the order dated 23.01.2019 of the Income-tax Appellate Tribunal by which the penalty of Rs.13 crore, which was imposed on the company in liquidation has been affirmed by rejecting the appeal. The present application relates to the filing of and prosecution of an appeal against the said order.

3. Since sufficient funds are available and the liability imposed on the company in liquidation is substantial, this application is liable to be allowed. Accordingly, this application is allowed in terms of prayers (b) to (d) of the report of the Official Liquidator.
