The present Miscellaneous petition has been filed seeking to condone the delay of 106 days in filing the above appeal against the order passed by the Learned Judicial Magistrate, No.I, Thirupattur, Thirupattur District in STC.No.97 of 2016 dated 03.03.2023.

2. Mr.C.Johnson, learned counsel appearing for the respondent vehemently opposed for allowing this petition.

3. Having satisfied with the reasons stated in the accompanying affidavit filed in support of this petition, this petition stands allowed.

4. Registry is directed to number the Criminal Appeal, if the papers are otherwise in order and post the main case for admission.
