ORDER : The Court Made the following order :- The petitioners, who apprehend arrest at the hands of the respondent police for the alleged offences under section 406, 410, 120B r/w 34 IPC, in Crime No.423 of 2021 seeks anticipatory bail.
2.The case of the prosecution is that one Mr.Praksah Joshi has transferred Rs.3 Crores to the bank account of M/s. K.V.Solutions as advance interest amount for the loan amount of Rs.62.5 crores, which is to be borrowed from M/s. K.V.Solutions and after the transfer of the amount the accused started avoiding the calls and not returned the advance amount. Herein, the petitioners are partners and salaried employee of the said firm. Hence, the defacto complainant lodged a compliant against the petitioners.
3.The learned counsel appearing for the petitioners submits that the petitioners are no way connected with the occurrence as alleged by the prosecution and they have been falsely implicated in this case. Hence, he prays for grant of anticipatory bail to the petitioners.
4.The learned Government Advocate (Crl.Side) submits that the investigation is at initial stage. Hence, he vehemently opposed grant of anticipatory bail to the petitioners.
5. Considering the allegation levelled against the petitioner and also considering that the investigation is at initial stage and the amount involved in the present case is more than 60 crores, this Court is not inclined to grant anticipatory bail to the petitioners. 6.Accordingly, this Criminal Original Petition is dismissed. -sd/- 02/12/2021 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
