ORDER

This petition has been filed to withdraw and transfer the case in HMOP. No.130 of 2024 from the file of the Family Court, Srivilliputhur, to the file of the Family Court, Chennai.

Heard the learned counsel on both sides.

The learned counsel appearing for the petitioner would submit that the respondent/husband filed HMOP No.130 of 2024 on the file of the Family Court, Srivilliputhur, seeking for the relief to dissolve the marriage and the same is pending before it. The petitioner/wife has no source of income and she is living with her parents in Chennai. Further, it will be very difficult to travel from Chennai to Srivilliputhur for attending the case. Hence, seeks the relief as prayed for.

4. The learned counsel appearing for the respondent/husband would submit that the respondent/husband has no objection in allowing this petition.

I have gone through the affidavit filed in support this petition and I find merit in the submissions made by the learned counsel for the petitioner/wife.

In view of the above and also considering the consent given by the other side, there can be no impediment for allowing this petition as prayed for.

7. Accordingly, this transfer civil miscellaneous petition is allowed. The case in HMOP. No.130 of 2024 is hereby withdrawn from the file of the Family Court, Srivilliputhur, and transferred to the file of the Principal Family Court, Chennai. The learned Principal Family Court, Chennai shall expedite the disposal of the case in HMOP. No.130 of 2024. No costs. Connected C.M.P. is closed.
