The petitioner, who was arrested and remanded to judicial custody on 26.08.2022 for the offences punishable under Sections 4(1-A) and 4(1)(aaa) of TNP Act, in Crime No.98 of 2022, on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner was found in possession of 115 litres of ID Arrack. Hence the complaint.

3. The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. Hence, he prays for grant of bail to the petitioner.

4. The learned Government Advocate (Crl. Side) appearing for the respondent would submit that the petitioner was found in possession of 115 litres of ID Arrack. He would further submit that there are 19 previous as against him and out of which, 15 cases are of similar nature. Therefore, he vehemently opposed to grant bail to the petitioner. 1/4

6. Heard both the learned Counsel and perused the materials available on record.

7. Taking into consideration the facts and circumstances of the case, the submissions made by the learned counsel and also the petitioner has got 19 previous cases as against him, out of which 15 cases are of similar nature, this Court is not inclined to grant bail to the petitioner.

8. Accordingly, this Criminal Original Petition stands dismissed for the present.
