Criminal Original Petition filed under Section 482 of Cr.P.C. praying to call for the records and quash the complaint in Cr.No.8 of 2016 pending on the file of the respondent police.

ORDER

This petition has been filed to quash the FIR registered in Cr.No.8 of 2016 pending on the file of the respondent police.

2. The learned Additional Public Prosecutor has submitted that initially the case was registered under Section 498-A of IPC and subsequently, further action dropped and it was closed on the file of the respondent police in Cr.No.8 of 2016. He further submitted that already they have completed the investigation and dropped further action in Cr.No.8 of 2016 as against which the respondent/Defacto Complainant filed a protest petition and further investigation was ordered. found that no offence is made out. Therefore, further action was dropped on 29.06.2020. Therefore, the prayer sought for in this petition has become infructuous and the same is dismissed. However, the learned counsel for the respondent/defacto complainant has submitted that no referred charge sheet notice was served on the second respondent/Defacto Complainant.

3. Considering the above said submission, the first respondent is directed to serve referred charge sheet notice to the respondent/Defacto Complainant within a period of two weeks from the date of receipt of a copy of this order.

4. In the result, this Criminal Original Petition is dismissed as infructuous.

Consequently, connected miscellaneous petition is closed.
