Crl.O.P.No.19442 of 2023 RMT.TEEKAA RAMAN, J.

The learned Government Advocate (Crl.Side) stated that there is a counter case was registered. Since the accused herein has underwent on road and therefore the counter case in Crime No.77 of 2022 was also registered.

2. On perusing the F.I.R as well as crime Nos.76 and 77 of 2022, I find that the de-facto complainant herein is a physically handicapped person with multiple disabilities and hence, I find that the crime number.77 of 2022 in counter case was altered and was came into existence because of the road rack conducted by the accused and that was put to him.

3. The learned Counsel appearing for the petitioner seeks permission of this Court to withdraw this petition and he has also made an endorsement to that effect.

4. In view of the submissions and the endorsement made by the learned counsel for the petitioner, this Criminal Original Petition is dismissed as withdrawn.
