Two cases in crime No.38 of 2023 for offences under Sections 294(b), 341, 342, 324, 352 and 506(ii) of IPC r/w Section 4 of Women Harassment Act and Crime No.39 of 2023 for offence under Sections 294(b), 448 and 506(ii) of IPC r/w Section 3(1) of PPDL Act against four persons on 08.04.2023, filed before this Court seeking anticipatory bail.

2. This is a sequence of two events, one at the ATM Centre, when these accused harassed two college girls and followed by wreckers in the hotel when these two girls left the hotel after taking food. Two of the accused A1 and A2 were arrested and granted bail and other two accused are before this Court.

3. Pending Anticipatory bail one of the accused was arrested and other petitioner also is at run, police states that they are in search of the second petitioner but who is shifting his place and could not be traced.

4. This is a case where four persons were unduly misbehaved with two college students while they were taking food, creating wreckers in the hotel causing damage to the public property. Though the other three persons were secured and released on bail, the second petitioner who is arrayed as A4 could not be traced and the police is on pursuit.

5. Considering the nature of the allegations that this petitioner who happened to be a hooligan in that area and have no rules and his conduct of absconding from the clutches of law force this Court dismiss this anticipatory bail on the ground that, if the petitioner were granted on anticipatory bail, he may not cooperate with the investigation and tends to get abscond. Accordingly, these anticipatory bail petitions are dismissed.
