ORDER

This Criminal Original Petition has been filed by the petitioner to direct the first respondent police not to harass the petitioner under the pretext of enquiry.

The learned counsel for the petitioner submitted that based on the complainant lodged by the defacto complainant/second respondent, earlier the respondent police issued summons and on receipt of the same, the petitioner appeared before the first respondent police and narrated that the dispute is only contractual transaction and civil in nature and despite the same, they are again 2/6

and again sending summons and harassing the petitioner since the defacto complainant is a Ward Counselor and belongs to the ruling party. Further, the second respondent has filed a civil suit for recovery and despite the same, with the help of the first respondent police, the second respondent is trying to exploit money from the petitioner.

3. The learned Government Advocate (Crl. Side) appearing for the first respondent police submitted that summons were issued to the petitioner, but he did not appear.

4. A perusal of the summon issued by the first respondent police shows that there was a commercial transaction between the parties and the dispute is civil in nature.

5. Therefore, the first respondent is directed to not to harass the petitioner and not to interfere with the civil dispute.

6. With the above directions, this Criminal Original Petition is disposed of at the admission stage itself.

7. However, the second respondent is at liberty to work out her remedy in the manner known to law.
