ORDER : The Court Made the following order :- The petitioner who was arrested and remanded to judicial custody on 20.11.2021 for the offence under Sections 328 of IPC and Section 7, 20(1) of COTPA Act 2003, in Crime No.480 of 2021, on the file of the respondent police, seeks bail.
2. The case of the prosecution is that on 20.11.2021, when the respondent police officials were on regular patrol duty, they found the petitioner transporting 210 Kgs. of banned tobacco products worth about Rs.1,85,000/-. Hence the complaint.
3.The learned counsel for the petitioner would submit that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. He would further submit that the petitioner has been suffering incarceration for more than 10 days from 20.11.2021. Hence, he would pray for grant of bail to the petitioner.

4.The learned government Advocate (Crl. Side) would raise strong objection stating that the petitioner transported banned tobacco products worth about Rs.1,85,000/- and he belongs to Assam State and if he is released on bail, there is every possibility that he would abscond and the investigation would be stalled. 5.On seeing the nature of allegation and the quantity of the alleged tobacco products and the petitioner belongs to other State and that the investigation has not been completed, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
