JUDGMENT

The learned counsel appearing for the appellant stated that the issues between the appellant and the respondent have been settled out of Court and he has also made the following endorsement to that effect:

"K.Myilsamy, counsel for the appellant, on instructions, the issues between appellant and respondent settled out of Court. Court fee paid in Appeal Suit may be returned. Hence, I am may be permitted to withdraw this Appeal Suit."

2.In view of the endorsement made by the learned counsel for the appellant, this Appeal Suit is dismissed as settled out of Court. The appellant is entitled for refund of Court fees in accordance with the Rules. No costs. Consequently, connected Civil Miscellaneous Petition is closed.
