PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C, praying to direct the 1st respondent to transfer the investigation in Cr.No.115 of 2019, pending on the file of the 3rd respondent police to the 4th respondent to investigate and for filing the final report, within the stipulated time as this Court may deem fit.

O R D E R
When the petitioner herein had filed the present Criminal Original Petition, the stage of the investigation was that the Inquest Report under Section 174 Cr.P.C. was awaited.
2. Today, when the matter was called, the learned Additional Public Prosecutor appearing for the respondent submitted that the offence has now been altered to Section 306 of I.P.C and the https://hcservices.ecourts.gov.in/hcservices/
accused, who is the son-in-law of the petitioner herein has already been arrested. The learned Additional Public Prosecutor would submit that the post-mortem report is awaited and the investigation is pending. In view of the alteration of the offence, it would be appropriate for the petitioner to await the outcome of the investigation.
3. In the light of the above observations, the Criminal Original Petition stands closed. Nevertheless, if the petitioner is aggrieved against the final report, it is always open to him to challenge the same before this Court.
