ORDER

This criminal miscellaneous petition has been filed to cancel the anticipatory bail granted to 2 nd respondent herein by this Court in Crl OP No.17497 of 2024 dated 26.07.2024.

2.The learned counsel for the petitioner submitted that after obtaining anticipatory bail, the 2 nd respondent went to the hospital where the defacto complainant taking treatment and threatened the defacto complainant with dire consequences and hence prays to cancel the anticipatory bail to the 2 nd respondent.

3.The learned counsel for the 2 nd respondent reported that originally the case was registered on the complaint of the defacto complainant due to the dispute regarding payment of autofare and in that case itself the defacto complainant was discharged from the hospital and thereafter he was granted anticipatory bail and he was regularly complying the conditions. After one month this false complaint has been lodged. He further submitted that this false complaint originally lodged before Thirupur North Police Station and they were not registered the case and thereafter petitioner went to the hospital after admitting himself and lodged the 2 nd complaint, which was taken up for enquiry in CSR No.207 of 2024.

Considering the fact that the 2 nd case is also came to be enquired in petition enquiry on 14.08.2024 and the original complaint was registered in the month of July 2024 and the final report with regard to earlier case is also filed, I am of view that the cancellation of anticipatory bail in this case is not necessary. 5.Accordingly, this Criminal Miscellaneous Petition is dismissed. 17-10-2025 gbi Index:Yes/No Speaking/Non-speaking order Internet:Yes
