This civil miscellaneous petition has been filed by the petitioner seeking to condone the delay of 47 days in filing the above tax case.

2. The learned Additional Government Pleader appearing for the petitioner filed a memo stating that the order impugned in these tax cases, has been accepted by the Commissioner of Commercial Taxes as it is covered under the litigation policy. Hence, the learned counsel prayed that the delay may be condoned and the tax case may be directed to be listed for withdrawal, after numbering the same.

3. Recording the submissions, the delay is condoned and this petition is accordingly ordered.

4. The Registry is directed to number the tax case, if it is otherwise in order and post for withdrawal on 22.09.2023.
