Respondents Prayer: Petition filed under Article 226 of the Constitution of India seeking a writ of Mandamus directing the respondents 1 to 3 herein to consider the petitioner representation dated 14.05.2023 and thereby

to remove the encroachment made by the respondents 4 to 6 in the Government Poramboke Pond (namely Amudhan Kulam) situated in S.No.218 to an extent of 28.05 Ares in Kazhiyappanallur Village, Tharangambadi Taluk, Mayiladuthurai District, within a time frame fixed by this Hon'ble Court.

ORDER

(Made by the Hon'ble Chief Justice) Heard Mr.P.Dinesh Kumar, learned counsel for the petitioner and Mr.P.Muthukumar, learned State Government Pleader, assisted by Mr.K.M.D.Muhilan, learned Additional Government Pleader for the respondents 1 to 3.

2. Learned counsel for the petitioner submits that the land in S.No.218 of an extent of 28.05 Ares in Kazhiyappanallur Village is a government poramboke pond/tank. The encroachment is made on the

said tank by the respondent nos.4 to 6.

3. Learned State Government Pleader, on the instructions of the Tahsildar, submits that the writ property would be surveyed by issuing notice to all the parties on 15.09.2023 and depending upon the report of the survey, further steps would be taken.

4. In view of the above statement, this writ petition stands disposed of. There will be no order as to costs. (S.V.G., CJ.) (P.D.A., J.) 24.08.2023 Index :
