ORDER

This writ petition has been filed for issue of writ of mandamus directing the respondents to refund a sum of Rs.50 Lakhs payable to the petitioner towards refundable security deposit in the account of the petitioner's solar power Plant HTSC No.069514420117.

2.Status report has been filed by the 2nd respondent. The relevant portions are extracted hereunder:

2. I submit that the petitioner has availed connectivity under a 50 MW pooling station commissioned by the Developer, Swelect Energy Systems Private Limited. The petitioner was issued a

3/6 "Noted for Record" letter dated 14.08.2024 for establishing a 2 MW Solar PV Power Plant with connectivity to the 110/33 KV Mondipatty 10(1) Substation, erected by the said Developer.

3. I further submit that the petitioner successfully commissioned the 2 MW Solar PV Power Plant on 27.01.2025, which is within 12 months from the date of issuance of the "Noted for Record" letter. Therefore, the petitioner is eligible for the refund of the security deposit of Rs. 20,00,000/-(Rupees Twenty Lakhs only). The same will be refunded to the petitioner within a period of six (6) weeks from the date of submission of original bills to the office of the Chief Engineer, NCES, TNGECL, Chennai. 3.The learned Standing Counsel appearing on behalf of the respondent Corporation submitted that the petitioner has to submit the original 'Noted for Record' letter and the Commissioning Certificate in order to enable the respondents to act upon the request made by the petitioner. 4.The learned counsel for the petitioner submitted that the original documents will be submitted before the respondents.

4/6 5.In view of the above, it is seen that the petitioner is entitled for the refund of the security deposit. Hence, there shall be a direction to the 2nd respondent to refund the security deposit to the petitioner, within a period of six weeks from the date of receipt of copy of this order. It is made clear that if the amount is not refunded within a period of six weeks, the same shall be liable to be refunded with interest at the rate of 6% per annum from the date it became payable till the date of actual payment.
