Prayer: This Writ Petition is filed under article 226 of the Constitution of India, praying to issue a Writ of Certiorarified Mandamus, calling for the records relating to the impugned order bearing Ref.No.2396/DHTE/Estt/ E5/PEC/2019/205 dt. 04.07.2019 passed by the 2nd respondent in appointing the 4th respondent as Principal of the 3rd respondent College and to quash the same as being illegal, arbitrary and unjunst and consequential Mandamus to the respondents to appoint the petitioner as the Principal of the 3rd respondent College within a time frame to be fixed by this Court and to grant all consequential benefits including the monetary benefits and to permit him to continue in the said post till the date of superannuation.

Despite the matter being listed under the caption "for dismissal" there is no representation on behalf of the petitioner, when the matter was 2/4

called in the forenoon session. Thus, the matter was passed over. Even when the matter was called again in the afternoon session, there was no representation on behalf of the petitioner.

2. There was no representation on behalf of the petitioner on earlier dates of hearing i.e., on 26.08.2025 & 09.09.2025. Thereafter, again on 23.09.2025, 28.10.2025 & 18.11.2025, when this Court had directed the matter to be listed under the caption "for dismissal". Thus, this Court is of the view that the petitioner is not interested to pursue the Writ Petition and accordingly, this Writ Petition is dismissed for non-prosecution. No costs.
