By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself. In view of the order that this Court proposes to pass and also the limited relief that is sought to be granted, notice to respondents 2 and 3 is dispensed with.

The present writ petition is filed praying for a writ of mandamus, to direct the 1st respondent to entertain and register any kind of document of encumbrance is presented for registration by the petitioner and his family members in respect of the petition property, being agricultural punja lands, comprised in Survey No.395/2A, measuring to an extent of 0.07.50 hectare (or) acre 0.19 cents and Survey No.395/2B, measuring to an extent of 3.10.50 hectare (or) acre 7.67 cents, totalling acre 7.86 cents, situated at Kizhmudalambedu Village, Gummidipoondi Taluk, Tiruvallur District.

It is the case of the petitioner that petitioner became the owner of the subject property by virtue of Settlement Deed dated 19.10.1978 registered as Doc.No.4139 of 1978 before the District Registrar, Madras North and he availed financial assistance from one D.Arunkumar Jain and executed a Mortgage Deed dated 23.01.2006 vide Doc.No.148 of 2006 registered before the 1st respondent. The grievance of the petitioner is that when the petitioner approached 1st 2/5
respondent for cancellation of Mortgage Deed dated 23.01.2006, 1st respondent refused to entertain the request of the petitioner by citing the pendency of the suit in O.S.No.97 of 2025 filed by the 2nd and 3rd respondents against the petitioner and others, wherein, no injunction order was passed. Hence, the present writ petition.
4. At the outset, this Court is not inclined to entertain this kind of writ petition inasmuch as the prayer is vague and preemptive in nature.
5. However, learned counsel for the petitioner would submit that they may be granted liberty to file documents in respect of the subject property and the same may be registered if it is otherwise in order, which was agreed to by the learned Special Government Pleader for the 1st respondent.
6. In view of the same, as and when any document is presented for registration, the same would be considered by the 1st respondent and may be registered if the same is otherwise in order. If for any reason, 1st respondent refuses to register the documents, the same shall be done by issuing a refusal slip assigning the reasons thereof. It is made clear that this Court has not expressed any views with regard to the merits of the matter and it is open to the 1st 3/5
respondent to consider the matter on its own merits and in accordance with law.
7. Accordingly, the writ petition stands disposed of with the above observation. No costs.
