ORDER

This writ petition has been filed for the issue of writ of Mandamus directing the respondent to effect change of the name of the petitioner's daughter as Prakshitha Shri instead of Prakshitha in the Adhar Card records.

When the writ petition was taken up for hearing today, the learned Central Government Standing counsel appearing on behalf of the respondents produced the Fax copy of the reply of the UIDAI. The relevant portions are extracted hereunder :- The ANH is providing a valid acceptable document (K. Prakshitha Shri to support her new name.

However, the ANH is not submitting a valid/acceptable (POI) document for her old name (K. Prakshiths) with photograph, resulting in the rejection of name update.

8. It is submitted that the ANH i.e., K. Prakshitha may be advised to visit any of the enrolment centers and change her name with the assistance of the operator and / or supervisor by providing Gazette Notification of name change (K. Prakshitha Shri) along with any supporting POI (Proof of Identity) document of old name (K. Prakshitha) with Photograph (such as Certificate of Disability (which is attached to the writ petition), Valid Indian Passport, Ration card, Domicile Certificate (digital), School Leaving Certificate (SLC)/ School Transfer Certificate (TC), ST / SC /OBC Certificate (digital) issued by Central Government / State Government and Passbook with photograph issued by a Public Sector Bank (as categorized by RBI), duly stamped and signed, along with a supporting certificate from the bank branch manager in charge certifying that KYC in respect of the account holder).

The learned Central Government Standing Counsel submitted that the petitioner must provide an acceptable document

as mentioned in Paragraph 8 carrying the old name of the petitioner (name before change) along with photographs. If the same is done, the respondents will be able to act upon the change of name that has been effected in the gazette and the changed name can be incorporated in the Aadhar card.

In the light of the above stand taken, there shall be a direction to the petitioner to comply with this procedure and on compliance of the same, the respondents are directed to effect the name change and issue a fresh Adhar card to the petitioner. 5.

This writ petition is disposed of with the above directions. No costs.
