A.No.4316 of 2022 A.No.4316 of 2022 in C.S.No.442 of 2019 C.V.KARTHIKEYAN,J., This application has been filed by the plaintiff seeking permission to produce two documents namely a copy of the letter relating to the notice issued under Section 120 by the plaintiff to the defendant, dated 09.06.2020 and Statement of Accounts for the period between 22.10.2020 and 28.10.2020 maintained by the plaintiff in Indian Bank.
2. It had been stated in the affidavit filed in support of the said application, that these documents are required to establish the claim made in the suit. It had been stated that the information had been produced from the computer system. It is stated that relevancy of those two documents can be adjudicated at the time of arguments advanced in the main suit.
3. Mr.P.M.Subramaniam, learned counsel on behalf of the respondent however placed a small objection that the accounts related to a subsequent period, than what was claimed in the suit. 1/2 https://www.mhc.tn.gov.in/judis

4. However as stated, relevancy of the Statement of Accounts can be examined at the time of arguments in the main suit. To determine relevancy, the documents must be taken on record. Subject to proof, admissibility and relevancy, the documents may be taken on record during the course of trial.
