(Order of the Court was made by R. SURESH KUMAR, J.) All the respondents were served except R1 who though initially was reported to be died, subsequently it was brought to our notice by the learned Special Government Pleader for the petitioners that, the first respondent is very much alive and he received notice also and produced a copy of the acknowledgment card.

2. Since the first respondent has been served and the delay is only 121 days, though he has not appeared before this Court, having satisfied with the reasons stated in the affidavit filed in support of the petition, this petition is ordered and the delay is condoned.

3. Registry is directed to number the appeal and place the same for admission, if the papers are otherwise in order.
