O R D E R

This criminal original petition has been filed seeking direction to the respondent to register the complaint of the petitioner dated 25.08.2015 and investigate the same in accordance with law.

2. It is the case of the petitioner that he preferred WP.Nos.36288 and 36277 of 2015 challenging the land acquisition proceedings initiated by the Housing Board and this Court has granted interim stay for the acquisition proceedings. The petitioner is in possession of the said land. While so, one Balaji and Chinnayan trying to encroach the petitioner's land by putting up a construction over the property. In this regard, the petitioner lodged a complaint before the respondent police. The said Balaji and Chinnayan on 25.08.2015 came along with rowdy elements and threatened the petitioner, but the petitioner refused to withdraw the complaint. On receipt of the said complaint, CSR has been assigned by the respondent police in CSR.No.118 of 2015. Till date, no action has been taken on the said complaint. Hence, the present criminal original petition has been filed.

3. Learned Additional Public Prosecutor submitted that on enquiry, it is found that the petitioner is claiming right over the land, which was already allotted under the Housing Board Scheme and thus, he opposes to grant a direction.

4. In view of the above, this Court is not inclined to grant a direction as sought for by the petitioner and this petition stands dismissed.
