PRAYER: This Writ Petition is filed under Article 226 of the Constitution of India, seeking issuance of a Writ of Certiorafied Mandamus calling for the records of the 2nd respondent dated 26.05.2025 in Proceedings No.Na.Ka.No.88/Na.Ka.Va/Thi/2025 and quash the same and consequently directing the respondents to grant permission and police protection to conduct Public protest/demonstration in front of Vaniyambadi Tanneries Association at Vaniyambadi, Tirupathur District on any date of Saturday between Morning 10 O' Clock to 2 O' Clock and to order any other remedy as this Honble Court. ORDER
This Writ Petition has been filed, seeking issuance of a Writ of Certiorarified Mandamus calling for the records of the second respondentPolice Proceedings dated 26.05.2025 in Na.Ka.No.88/Na.Ka.Va/Thi/2025 and quash the same and consequently direct the respondents-Police to grant permission and Police protection to conduct public protest/demonstration in front of Vaniyambadi Tanneries Association at Vaniyambadi, Tirupathur District on any date of Saturday between Morning 10 O' Clock and 2 O' Clock. 2/5
2.Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) appearing for the respondents-Police and perused the materials available on record.
3.On a perusal of the records, it is seen that the petitioner made representations dated 21.5.2025 & 26.5.2025 before the respondents-Police seeking permission for the public protest/demonstration to express their opposition to an action of the Tannery Management. The second respondentPolice, vide impugned order dated 26.5.2025, denied the permission for the public protest/demonstration. Aggrieved by the same, the petitioner has filed this writ petition. Further, it is seen that the petitioner had already obtained order of this Court on 09.12.2024 and their demand is genuine. Therefore, the impugned order passed by the respondents-Police is unreasonable. Hence, this Court is inclined to allow this writ petition. 3/5
4. Accordingly this petition is allowed and the impugned order dated 26.5.2025 passed by the second respondent-Police is set aside. The petitioner is directed to give fresh representation to the respondent-Police and on receipt of same, the respondent-Police is directed to give adequate police protection for demonstration on a specific date.
