MAHADEVAN CMP No.4001 of 2017 IN CMA.NO.721 OF 2017 THE BRANCH MANAGER [ PETITIONER ] ICICI LOMBARD GENERAL INSURANCE COMPANY LTD, NO.140, 2 AND 3RD FLR, NUNGAMPAKKAM HIGH ROAD, NUNGAMPAKKAM, CHENNAI VS M.PANNEERSELVAM [ RESPONDENT ] Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to stay the operation of judgment and decree in MCOP NO.29 of 2012 dated 07/09/2016 on the file of the Motor Accident Claims Tribunal cum Chief Judicial Magistrate, Tiruvannamalai till the (IN CMP.NO.4001 OF 2017)disposal of the above CMA.NO.721 OF 2017.

Order : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S. K.K. RAMAKRISHNAN, Advocate for the petitioner and of M/S.M.MALAR on behalf of the Respondents the court made the following order:- This Court, by order dated 14.03.2017, granted an order of interim stay on condition to deposit 50% of the award amount by the appellant/insurance company, within a period of four weeks. While passing such an order, it was specifically mentioned therein that in the event of failure on the part of the appellant to deposit the said amount within the specified period, the interim stay granted would stand automatically vacated without any further reference to this Court.

2. Today, the learned counsel for the appellant was unable to state whether the aforesaid conditional order has been complied with by the appellant/insurance company or not. https://hcservices.ecourts.gov.in/hcservices/

3. In view of the above, this petition stands closed, by virtue of the specific clause in the order dated 14.03.2017 as stated in the paragraph No.1 of this order.
