Habeas Corpus Petition filed under Article 226 of the Constitution of India, praying for issuance of a Writ of Habeas Corpus to directing respondents to produce the body of petitioner's wife and his child by names Sugandha daughter of Govindaraju aged 24 years and Divyadharshini daughter of Anandhakumar aged four years before this Court and set her at liberty.

O R D E R

(The Order of the Court was made by M. M.SUNDRESH,J.,) Alleging that the detenue Sugandha and her child namely Divyadharshini are in the illegal custody of the third respondent, the present HCP has been filed by the petitioner, who is the husband of the detenue.

2.Today, status report has been filed by the second respondent. From the status report filed coupled with the submission made by the learned Additional Public Prosecutor, it appears that it is a case of elopement of the wife of the petitioner along with his child with the third respondent. 3.In such view of the matter, we do not find any illegal detention involved. However, the respondents 1 and 2 shall proceed with the investigation and if the detenue and her child are found, they should be produced before the concerned Jurisdictional Magistrate. This Habeas Corpus Petition is accordingly closed.
