PETITION under Article 226 of The Constitution of India praying for the issuance of a Writ of Mandamus directing the respondents to consider the petitioner's representation dated 26.8.2016 and consequently direct the second respondent to issue a patta to the house property bearing old S.No. 293/16A07, new S.No.450/1, Kallakurichi Taluk.

ORDER

Mr.P.Chinnadurai, learned Government Advocate accepts notice for the respondents. Heard both.

2. The petitioner seeks a direction to the second respondent to issue patta for his property bearing old S.No. 293/16A07, new S.No.450/1, Kallakurichi Taluk, by considering his representation dated 26.8.2016.

3. On perusal of the representation dated 26.8.2016, it is not clear as to how the petitioner came into possession of the property in question and what is the classification of the property and other details. Therefore, when such a representation is bereft of particulars, a Writ of Mandamus, as sought for, cannot be granted.

4. Accordingly, the writ petition is dismissed. No costs. https://hcservices.ecourts.gov.in/hcservices/

5. However, liberty is granted to the petitioner to approach the second respondent by producing all documents and establish his title to the property and if done so, the second respondent shall consider the request made by the petitioner on merits and in accordance with law.
