The petitioner has filed this petition seeking to modify the conditional amount imposed in the order dated 12.04.2023 made in Crl.O.P.No.6463 of 2023.

2.Heard the learned counsel appearing for the petitioner and the learned Special Public Prosecutor (CBI).

3.The learned counsel appearing for the petitioner submitted that since the petitioner is in prison for more than two years, he is not in a position to deposit the amount as agreed by him on 12.04.2023 and prayed to modify the condition.

4.The learned Special Public Prosecutor (CBI) submitted that the total loss caused by the accused is Rs.60,56,000/-, out of which, a sum of Rs.8 Lakhs has already been paid by the accused. On 12.04.2023, since the petitioner himself came forward to deposit a 1/3

sum of Rs.5 Lakhs, this Court granted bail to him. Now the petitioner has turned out to say that he is not in a position to deposit the amount. Hence, this Court need not consider this petition seeking modification of the conditional amount.

5.On 12.04.2023, since the petitioner himself came forward to deposit a sum of Rs.5 Lakhs, this Court directed the petitioner to deposit a sum of Rs.5 Lakhs to the Kancheepuram Central Cooperative Society Bank, Pallavaram Branch and granted bail to him, however, till date the said condition has not been complied with. 6.In view of the above, this criminal miscellaneous petition seeking modification of the conditional amount is mis-conceived and this petition is therefore dismissed.
