Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus directing the respondents to consider the case of the petitioner for appointment to the post of Cook, under the fourth respondent.

O R D E R

This Writ Petition has been filed praying for issuance of a Writ of Mandamus directing the respondents to consider the case of the petitioner for appointment to the post of Cook, under the fourth respondent.

2. The petitioner belongs to Scheduled Tribe community and hailing from a poor family. He has completed a course in Trade of Food Production and Industrial School Certificate was also issued by the Government of Tamil Nadu, Department of Employment and Training, Chennai on July, 2006. The petitioner had registered with the Employment Office, Namakkal, vide Reg.No.NKD 2012 M00021250 seeking suitable employment. While so, he received an interview call letter from the office of the fourth respondent in Ref Na.Ka.No.2063/2015/D2 dated 10.07.2015 instructing him to appear for interview for appointment to the post of Cook.

On the next day, a news item was published, wherein the District Collector, Namakkal, the third respondent herein, announced that 14 posts of cook were going to be filled up in Adi Dravidar Welfare Department of Namakkal District. Since the petitioner was found eligible to be appointed to the post of Cook, his name was sponsored by the Employment Exchange, Namakkal and the petitioner appeared for interview before the fourth respondent by producing all the certificates on 23.07.2015 and though he was fully qualified, he was not selected. On attending the interview only the petitioner came to know that nearly 600 candidates had appeared for the interview on that day itself. The petitioner would contend that candidates numbering about 600 were interviewed on a single day and the conduct of interview on 23.07.

2015 was just an eye-wash and hence, the petitioner has come forward with the present writ petition.

3. When the matter is taken up for consideration, Mr.K.Dhananjayan, learned Special Government Pleader appearing for the respondents would contend that there is absolutely no merit in the contention raised by the petitioner and sought for dismissal of the writ petition.

4. This Court, without going into the merits of the claim projected by the petitioner, directs the respondents to consider the case of the petitioner for appointment to the post of Cook, under the fourth respondent, if he is found eligible to the said post and pass appropriate orders within a period of four weeks from the date of receipt of a copy of this order.

5. This Writ Petition is disposed of accordingly. No costs. Consequently, connected miscellaneous petition is closed.
