Respondents Prayer: Criminal Original petition filed under Section 482 of Code of Criminal Procedure, to modify the above bail condition (a) ordered in Crl.M.P.No.9068 of 2019, dated 14.08.2019, to accept the surety from the marital family of the above petitioner-1/accused, either his wife Smt.Bismi or the mother in law Smt.Latheefa, W/o.Basheer, instead of offering blood relative as surety, ordered in Crl.M.P.No.9068 of 2019, by order dated 14.08.2019, on the file of the CCB and CBCID Metropolitan Magistrate Court, Egmore, Chennai - 8, concerning Crime No.157 of 2019, on the file of the above respondent police. O R D E R

This petition has been filed seeking for modification of the condition imposed by the Court below, while granting bail to the petitioner.

2. The petitioner was granted statutory bail by the Court below, by an order dated 14.08.2019. The Court below imposed certain conditions, while granting bail. One such condition that was imposed by the Court below was that one of the surety was directed to be a blood relative of the petitioner.

3. The learned counsel for the petitioner submitted that there are no blood relatives available for the petitioner and instead of blood relative, the wife of the petitioner will stand as one of the surety in this case.

4. Heard, the learned Additional Public Prosecutor, appearing on behalf of the respondent police.

5. Taking into consideration the facts and circumstances of the case, the condition (a) imposed by the Court below is modified to the effect that the petitioner shall execute a bond for a sum of Rs.10,000/- along with two sureties for a like sum and one such surety shall be the wife of the petitioner. The other conditions imposed by the Court below, shall stand as it is.

6. This Criminal Original Petition is disposed of accordingly.
