C.M.P.No.3009 of 2017 in S.A.No.143 of 2017 S.SOUNTHAR,J.

The petition has been filed seeking stay of decree for declaration and injunction granted in favour of the 1st respondent. It is seen from the records that there has been no interim order from 2017 onwards. The suit filed by the respondents 1 and 2 was decreed by the Trial Court and confirmed by the 1st Appellate Court. Challenging the concurrent findings, the 1st defendant/appellant herein has come up by way of second appeal.

2. Since the petitioner does not enjoy any interim order for the past six years, the civil miscellaneous petition is closed.
