ORDER
This Writ Petition has been filed praying to direct the 1st and 2nd respondents to dispose of the petitioners representation dated 23.4.2025 and appoint the petitioner to the post of Assistant Engineer/Civil through Internal selection, within time frame. 2.The learned counsel for the petitioner would submit that the petitioner was appointed to the post of Field Assistant (Trainee) vide letter dated 25.05.2022. However, he was directed to join on 11.07.2022. It is further contention of the petitioner's counsel that the respondent issued notification on 01.02.2024 for the post of Assistant Engineer through Internal Selection, wherein the required qualification for the employees to apply for the said post enumerates that they should have been appointed on or before 07.06.2022.
It is contention of the petitioner that though he was issued appointment order on 25.05.2022, he was directed to join office on 11.07.2022 subsequent to the letter dated 17.06.2022 calling upon the petitioner for certificate verification. In view of the above, the respondents application portal do not accept the petitioner's application. In this regard, he has sent representation dated 23.04.2025 and the same is pending before them.
3. At this Juncture, the Standing Counsel for the respondents would submit that in the similar case, this Court directed them to consider such representations for those who have applied to
the said post for internal selection and now the selection has already been over. Hence, the petitioner cannot take advantage of the earlier order as prayed in the writ petition.
4. This court has given anxious consideration having heard both sides and perused the material available on record.
5.In view of the submissions made on either side, the fact remains that the petitioner's representation dated 23.04.2025 is pending before the respondents. Hence, this Court without going into the merits of the case, deems it appropriate to direct the 2nd respondent to consider the petitioner's representation and pass orders in accordance with law within a period of eight weeks from the date of receipt of copy of this order.
