This Criminal Miscellaneous Petition has been filed seeking to cancel the bail granted to the respondent/accused in Crl.O.P.No.13987 of 2024 dated 03.07.2024 by this Court, in Spl.C.C.No.22 of 2024 on the file of the learned Special Judge for Essential Commodities NDPS Act Cases, Salem.

2. The learned Government Advocate (Crl.Side) submitted that the respondent was found in possession of 38 kgs Ganja and the same was arrested. Thereafter, the respondent/accused has move bail application before this Court and the same was ordered on 03.07.2024. He further submitted that the respondent is a owner of the contraband as well as the car. Hence, he prayed to cancel the bail order dated 03.07.2024.

3. The learned counsel for the respondent submitted that the entire contraband was recovered only from the second accused and there is no recover from the respondent/accused. Hence, he prayed for dismissal of this petition.

4. As per the records, it reveals that the respondent/accused is a owner of the contraband as well as the car. Further, he is having 4 previous case out of which one case is NDPS Act and other three cases IPC and it was not been informed before this Court and it is a commercial quantity and the car was belongs to him.

5. In view of the above, the bail granted by this Court by order dated 03.07.2024 in Crl.O.P.No.13987 of 2024 is hereby cancelled. Further, the petitioner is directed to secure the respondent/accused. Accordingly, this Criminal Miscellaneous Petition is allowed.
