1. This is a petition to substitute the petitioner herein in place of deceased petitioner K.Kumar in writ petition No.7871 of 2012. 2.Learned counsel for petitioner places before me an order dated 01.10.2007 made in W.P.(MD).No.3071 of 2004 to butters his plea and say that in service law such substitution is permissible. In the said order learned counsel draws my attention to paragraph 10.

3. The substitution petition is allowed. It is noticed that respondents 1 to 3 have filed a common counter affidavit and fourth respondent has filed a separate counter affidavit. As the pleadings are complete, considering the nature of the matter, the request made by both counsel at the Bar to fix an early date for final disposal is acceded to.

4. 20.01.2017 is the date fixed for final hearing.
