The learned counsel for applicant submitted the 1st defendant sent a letter to the plaintiff stating that 2nd defendant died on 15.03.2022. On the death of 2nd defendant, it will not make any difference as the property does not belong to him since it belongs to the 1st defendant society and therefore, it is not necessary to implead the legal heirs of the 2nd defendant Govindaraj and in the circumstances, the 2nd defendant is to be removed from the causelist and the 1st defendant should be shown as sole defendant. 3.
