These applications have been filed to condone the delay of 114 days in filing the petition to set aside the abatement caused by the death of the first respondent viz., Alamelu; to set aside the abatement caused due to the death of the first respondent; and to bring on record the legal representatives of the deceased first respondent, as respondents 5 to 7 in the Second Appeal.
2. According to the petitioners, the first respondent, Alamelu died on 27.11.2022 and the respondents 5 to 7 are the legal representatives of the deceased first respondent.
3. Heard both sides and perused the materials available on records.
4. Considering the submissions made on either side and being satisfied with the reasons stated in the affidavit filed in support of these petitions, the delay is condoned and all the Civil Miscellaneous Petitions are allowed.
5. Registry is directed to carryout necessary amendment in the second appeal.
