These applications have been filed to condone the delay of 360 days in filing the petition to set aside the abatement caused by the death of the 3rd appellant viz., Irusayee; to set aside the abatement caused due to the death of the third appellant; and to bring on record the legal representatives of the deceased third appellant, as appellants 5 to 8 in the Second Appeal.

2. According to the petitioners, the third appellant, Irusayee died on 26.03.2022 and the appellants 5 to 8 are the legal representatives of the deceased third appellant.

3. Heard both sides and perused the materials available on records.

4. Considering the submissions made on either side and being satisfied with the reasons stated in the affidavit filed in support of these petitions, the delay is condoned and all the Civil Miscellaneous Petitions are allowed.

5. Registry is directed to carryout necessary amendment in the second appeal.
