Writ Petition filed under Article 226 of the Constitution of India praying for a issuance of a Writ of Mandamus directing the respondents to take appropriate steps to calculate and pass necessary award and disburse the compensation to the petitioner at the earliest possible time.

O R D E R

The case of the petitioner is that he owned agricultural lands in R.S.Nos.65/2 and 67/1 of Vendipalayam village, Erode Taluk. A part of that lands was utilized by the Government for a public purposes involving construction of Barrage across the Cauvery river for the purpose of producing electricity.

2. This acquisition had taken place in the year 2002 and ever since he was running after the authorities for initiating a proper land acquisition and to proceed with payment of compensation.

3. Mr.M.Karthikeyan, the learned Additional Government Pleader entered appearance for the respondents and he has circulated that on the basis of the private negotiation, compensation payable was arrived at between the parties. A copy of the communication addressed by the District Collector, Erode too was made available to this Court. The learned Additional Government Pleader also made a statement that the State would disburse the compensation amount as agreed between the parties within eight weeks from now. This undertaking of the learned Additional Government Pleader is also recorded. The learned counsel for the petitioner also confirms this development.

5. In view of the said development, nothing survives presently for the consideration of this Court. Hence, this petition is disposed of accordingly. No costs. Consequently, connected Miscellaneous Petition is closed. Post the case for reporting compliance after three months.
