Respondents 2 and 3, driver and owner of the vehicle remained ex parte before the Tribunal. Since the appellant / insurance company preferred the appeal questioning the quantum, this Court considers that notice to the respondents 2 and 3 is not necessary.

2.Heard both sides. Having satisfied with the reasons stated in the accompanying affidavit filed in support of this petition, this petition stands allowed.

3.The Registry is directed to number the above C.M.A.SR.No.61274 of 2023, if the papers are otherwise in order.
