2. Heard the learned counsel for the petitioner and the learned counsel for the second respondent. The first respondent is already set exparte before the Trial Court and the contesting respondent/second respondent has no objection in allowing this petition.

3. Being satisfied with the reasons stated in the affidavit filed in support of the petition, this petition is allowed and the delay of 11 days in filing the appeal is condoned.

4. Registry is directed to number the appeal, if the papers are otherwise in order.
