By the present writ petition, the petitioner assailed the action of first respondent placing him under suspension vide proceedings dated 18.02.2017.

2.When the matter is taken up for hearing, the learned counsel appearing on behalf of the 2nd respondent has placed before this Court the subsequent proceedings dated 13.10.2025, whereby, the petitioner has been dismissed from service pursuant to the disciplinary proceedings initiated by the respondent authorities.

3. Since the petitioner has now been dismissed from service vide proceedings dated 13.10.2025, this Court is of the view that the petitioner has to assail the action of respondent by availing remedy open to him under law.

4. In view of the subsequent development, this Court is of the view that the challenge in the present writ petition to the suspension order dated 18.02.2017 cannot be considered and thus nothing survives in the writ petition for adjudication.

5. Accordingly, this writ petition is closed as infructuous by granting liberty to the petitioner to assail the action of the respondent authorities for 2/4

issuing proceedings dated 13.10.2025. No order as to costs. Consequently connected miscellaneous petition is closed.
