A.No.4478 of 2021 has been filed by the applicant/plaintiff seeking to condone the delay of 45 days in filing the application to set aside the abatement caused in view of the death of the defendant in C.S.No.175 of 2020. 2.

A.No.4479 of 2021 has been filed seeking to set aside the abatement caused due to the death of the defendant in C.S.No.175 of 2020. 3.

A.No.4480 of 2021 has been filed seeking to bring on record the legal representatives of the deceased defendant in C.S.No.175 of 2020. 4.

The learned counsel for the second and third respondents in these applications has 'No Objection' for allowing these applications.

This Court is satisfied with the reasons contained in the affidavit filed in support of the aforementioned applications. 6.

Accordingly, these applications are allowed as prayed for. The plaintiff is directed to carry out the amendment in terms of today's order. 7.

However, in the connected suit, namely, Tr.C.S.No.147 of 2021, similar applications will have to be filed by the plaintiff to bring on record the legal representatives of the deceased plaintiff, for which, learned counsel for the second and third respondents in these applications seeks time. 8.

Post the matter on 11.02.2022.
