ORDER : The Court Made the following order :- The petitioner, who apprehends arrest for the alleged offence under Sections 174 Cr.P.C (death due to hanging), later altered to Section 306 of IPC in Crime No.478 of 2021, seeks anticipatory bail.

2. The case of the prosecution is that the said Kalpana Devi was working as a nurse in the Government Hospital, Hosur and her husband Karthick Raja is a lorry driver by profession. It is alleged that on 19.11.2021 the complainant had received a phone call from her son in law about the hanging committed by her daughter. Immediately, the complainant and her relatives came over to Hosur Government Hospital on 20.11.2021 and saw her daughter lying dead. It is alleged that the deceased Kalpana Devi developed an affair with the petitioner who is also working in the same Government Hospital, Hosur, which came to the knowledge of her husband Ramesh Kumar who has humiliated and harassed his wife to commit suicide. 3. The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail.

4. The learned Government Advocate (Crl.Side) submitted that the investigation is pending. However, he vehemently opposed to grant anticipatory bail to the petitioner.

5. Considering the allegations and the nature of the offences involved in this matter and the investigation is in initial stage, this Court is not inclined to grant anticipatory bail to the petitioner.
