Writ Petition filed under Article 226 of the Constitution of India praying to issue a writ, order or direction specifically writ in the nature of Writ of Mandamus issue directing the respondents to grant compassionate appointment to the petitioner to the suitable post in respondents department by considering the representations submitted by the petitioner on 20.09.2012, 03.08.2016, 02.09.2016 & 18.12.2017 and pass such further other orders.

With the consent of both the parties, the Writ Petition is taken up for final disposal at the state of admission itself.

2. The petitioner has filed this Writ Petition seeking directing the respondents to grant compassionate appointment to the petitioner to the suitable post in respondents department by considering the representations submitted by the petitioner on 20.09.2012, 03.08.2016, 02.09.2016 & 18.12.2017.

The case of the petitioner is that the petitioner father was working as a Light Motor Vehicle Driver (LMV) in the 3rd respondent department at Sankari and his father rendered his unblemished service. In the year 2006, his mother expired due to illness and his father was taking care of the petitioner and his younger brother. Thereafter on 09.07.2010 his father had also expired. After the demise of his father on 20.09.2012, the petitioner made representation to the second respondent for compassionate appointment, but till date his representation was not considered. Hence the present Writ Petition is filed.

4. The learned counsel for the petitioner submitted that though the petitioner has no proof to show that the petitioner made representations since all the representations were submitted in person but till date representations were not considered.

5. In view of the above, after nine years of the death of his father, the petitioner is not able to show that he made representation within appropriate time. In the absence of any proof, I am not inclined to issue any positive direction accordingly. The Writ Petition is dismissed. No costs.
