Respondents Prayer:- Petition filed under Article 226 of the Constitution of India, seeking for the issuance of Writs of Mandamus, directing the respondents, their men and subordinates, not to interfere with the day-to-day affairs of the petitioners club namely "Arignar Anna Pozhuthupokku Vilaiyattu Sangam Malaiyandahalli" more particularly playing the game of rummy. O R D E R

Heard Mr.D.Baskar, learned counsel for the petitioner and Mr.A.N.Thambidurai, learned Special Government Pleader for the respondents. By consent of the learned counsel for both sides, the writ petition is taken up for final disposal at the admission stage itself.

2. It is unfortunate that the petitioner-society, which has adopted the name of the illustrious person from our State, has approached this Court by stating that they are running a club and not doing any unlawful activities, but only permitting the members and others to play rummy. https://hcservices.ecourts.gov.in/hcservices/

3. Firstly, this Court does not approve the conduct of the petitioner in adopting the name of the said illustrious person and appears to have come to adverse notice of the Police.

4. In any event, this Court cannot issue a blanket order against the respondents / Police, not to take any action. It is for the respondents to examine as to whether there is any violation of law committed by the petitioner and it would be advisable for the petitioner to adopt a different name, than the name now chosen by the petitioner, especially when the petitioner is a recreation club, allowing members only for the purpose of playing cards and stating that they are not engaged in gambling. Leaving it open for the third respondent to take action, in accordance with law, only in cases of violation, it is made clear that there shall not be any harassment to the members of the said Association.

5. This writ petition is dismissed with the said observations. No costs. Consequently, the connected WMP is closed.
