Prayer: Writ petition filed under Article 226 of the constitution of India for issuance of a writ of mandamus to direct the respondent to consider his application dated 25.07.2016 bearing File No.MAS079528736116 for Re-Issue of passport No.G 1530875 and issue the passport to the petitioner immediately.

This writ petition is filed only seeking to re-issue passport of the petitioner.
2.According to the petitioner, though his application is pending from 25.07.2016, till date no order has been passed. Learned counsel for the petitioner submitted that the FIR is pending and that mere pendency of FIR is not a bar to re-issue the passport of the petitioner.
3.Learned counsel for the respondent submits that they are investigating the details of the FIR.

5.Considering the fact that the mere pendency of the FIR is not bar to issue passport to the petitioner, this court directs the authority concerned to consider the application of the petitioner and pass orders, if he is otherwise eligible within a period of three weeks. The writ petition is disposed of accordingly. No costs.
