C.M.P.No. 16694 of 2022 in C.R.P. No. 3423 of 2012 T.V. THAMILSELVI, J.

This petition has been filed seeking to condone the delay of 1119 days in filing the petition to restore the C.R.P. No.3423 of 2012, which was dismissed for default on 24.07.2019.

2. Mr.A.J.Alwyn Prabakar, learned counsel for revision petitioner submitted that when the petitioner enquired about the case, he came to know that his previous counsel was suffering from Domentia and other allied medical issues and he left his practice permanently during the year 2018. After coming to know about the same, the petitoner applied for order copy and engaged the present counsel and filed this petition to restore the above C.R.P.

3. Both learned Addl. Government Pleader Mr.B.Tamilnidhi, appearing for 1st respondent and Mr. P.Anbarasan, learned counsel for 2nd respondent appeared and raised their formal objections.

4. Considering the facts and circumstances, and being satisfied with the reasons assigned in the affidavit filed in support of the petition seeking to condone delay of 1119 days, this Court is inclined to allow this petition and to restore the above Civil Revision Petition. 13.10.2022 rpp https://www.mhc.tn.gov.in/judis
