4.S.Girija 5.Arjun ... Respondents This case came up for settlement before the National Lok Adalat. Both the parties are present. Mr.D.Harikrishnan, learned counsel for the appellant/Insurance Company and Mrs.V.Ramya Rao, learned counsel for respondents/claimants are present. After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter as follows:
TERMS OF SETTLEMENT The appellant/Insurance Company has preferred this Civil Miscellaneous Appeal seeking to set aside the Award dated 28.04.2025 in M.C.O.P.No.1324 of 2023 passed by the learned Special District Judge No.1, Motor Accident Claims Tribunal, Cuddalore.
2. The Tribunal has passed an award of Rs.23,91,500/- with interest at the rate of 7.5% per annum from the date of petition till the date of deposit along with cost.
3. The parties are present along with their respective counsels.
4. After great deliberation and discussion, both the parties have agreed for enhancement of award amount with
further additional sum of Rs.26,00,000/- in full quit (inclusive of interest).
5. In view of the compromise arrived at between the parties, the National Lok Adalat hereby declare and decree that appellant/Insurance Company shall deposit the enhanced award amount of Rs.26,00,000/- (Rupees Twenty Six Lakhs only) in full quit (inclusive of interest) less the amount already deposited before the Tribunal, within a period of four weeks from the date of receipt of a copy of this award, at the first th instance and thereafter, recover the same from the 5 respondent (owner of the vehicle) as per the order of the Tribunal. On such deposit, respondents/claimants are permitted to withdraw the enhanced award amount immediately, without filing any formal petition, before the competent Court.
6. It is made clear that out of the enhance award amount of Rs.26,00,000/-, respondents 1 to 4 are entitled to their respective share as per the apportionment ordered by the Tribunal.
7. The Tribunal is directed to issue the cheques to the parties concerned on proper identification in accordance with the terms of the award, without insisting on any formal permission petition. The Civil Miscellaneous Appeal is disposed of accordingly. Consequently, connected Miscellaneous Petition is closed.
