Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India seeking to issue a Writ of Mandamus, directing the respondent to pass orders on the application of the petitioner dated 10.03.2014 and reminder dated 22.11.2021 and issue community certificate to the petitioner and his children viz., S.Theekshith and S.Thikshika Sri that they belong to Kurichchan (ST) Community based upon the community certificate already issued to the petitioner's father's own brother E.Sankaranarayanan, which was verified by the State Level Scrutiny Committee in Proceedings No.5364/CV111/2011, dated 13.02.2015.

ORDER

(The Order of the Court was made by K.KALYANASUNDARAM, J) The Writ Petition is heard through video conferencing.

2. The petitioner seeks for issuance of a Writ of Mandamus, directing the respondent to pass orders on the application of the petitioner dated 10.03.2014 and the reminder dated 22.11.2021.

3. The learned counsel appearing for the petitioner Mr.V.Elangovan, would state that the petitioner belongs to Kurichchan Community, which is a Scheduled Tribe Community. The petitioner has successfully completed M.Sc., M.Phil., and currently doing P.Hd. It is the submission of the learned counsel that on 10.03.2014, an application was submitted for issuance of Community Certificate to the petitioner as well as his children, viz., S.Theekshith and S.Thikshika Sri. Since no action was taken, a reminder dated 22.11.2021 was sent, but even though no order has been passed on the application of the petitioner.

4. It is also submitted that in respect of the blood relative of the petitioner, a certificate was issued in their favour, which was found to be genuine by the State Level Scrutiny Committee.

5. The learned Special Government Pleader appearing for the respondent Mr.K.V.Sajeev Kumar on instructions would state that the application of the petitioner is still pending and the enquiry is in progress. The respondent is ready to pass orders on the application of the petitioner within a period of four weeks.

6. In the light of the submissions of the learned counsels appearing on either side and also considering the facts of the case, this Writ Petition is disposed of, directing the respondent to pass orders on the application of the petitioner dated 10.03.2014 within a period of four weeks, after affording ample opportunity to the petitioner.
