This petition has been filed for a direction to the respondent to defreeze the bank account of the petitioner maintained at Indian Overseas Bank, Nadaikavu Branch, Kanyakumari District.

2.The learned Additional Public Prosecutor on instructions submitted that the respondent in the course of investigation in Crime No.252 of 2022 had freezed the bank account of the petitioner on 14.08.2023. However, the mandate under Section 102 of Cr.P.C., has not been followed. 3.In view of the above, there shall be a direction to the respondent to defreeze the bank account of the petitioner, since the mandate under Section 102 of Cr.P.C., has not been followed. If the respondent wants to freeze the bank account of the petitioner in the course of investigation, the respondent shall strictly comply with the procedure adumbrated under Section 102 of Cr.P.C., 4.This criminal original petition is disposed of with the above directions. 2/4
