This Criminal Revision Case has been filed challenging the order dated 08.05.2024 passed in Crl.M.P.No.3691 of 2022 on the file of the Judicial Magistrate, Gingee, Villupuram District, thereby dismissing the private complaint.
2. Heard the learned counsel appearing for the petitioner and perused the materials available on record.
3. A perusal of the complaint lodged by the petitioner reveals that the respondents had obtained patta for the land, which is situated behind the house of the petitioner and they are in possession of the said property. The petitioner claims that the said land belongs to him. However, the petitioner failed to make out a prima-facie case for taking cognizance of any offence as against the respondents. The petitioner ought to have approached the civil Court for appropriate relief. In fact, the petitioner did not even challenge the patta issued in favour of the respondents in the manner known to law. Therefore, the Trial Court has rightly dismissed the complaint.
4. In view of the above, this Court finds no infirmity or illegality in the order dated 08.05.2024 passed in Crl.M.P.No.3691 of 2022 on the file of
the Judicial Magistrate, Gingee, Villupuram District.
